26 Year-Old Abita Springs Man Gets 40 Years for Manslaughter

District Attorney Collin Sims reports that on July 1, 2024, 26-year-old Dain McCann of Abita Springs pled guilty to manslaughter and obstruction of justice and was sentenced by District Judge John Keller to 40 years in prison on each count with both sentences running concurrent with each other. The case was prosecuted by Assistant District Attorney Tiffany Dover.

Shortly before midnight on August 30, 2022, deputies with the St. Tammany Parish Sheriff’s Office were dispatched to an Abita Springs residence in response to a report of a shooting. Deputies found 30-year-old Jon McIntyre with multiple gunshot wounds to his upper chest, abdomen and right arm. McIntyre was still conscious when the initial deputies arrived and he advised one deputy that “Dain McCann” shot him. Shortly thereafter, McIntyre became unresponsive and succumbed to his injuries. 

Two hours later, a family member of McIntyre’s approached one of the deputies and told him she believed she just saw McCann on the porch of a nearby residence. Deputies quickly relocated to the residence in question and found a man on the front porch. When asked his name, the man said he was “Devin”. Deputies obtained a photograph of Dain McCann and confirmed the man claiming to be “Devin” was in fact McCann. After being Mirandized, McCann admitted shooting McIntyre. McCann said the victim aggressively approached him with a metal object in his hand, accusing McCann of owing him money. McCann said he pulled out his handgun and shot the victim three or four times in self-defense. When questioned further, McCann acknowledged he lied and that the victim was not armed with any weapon when McCann shot him. When detectives inquired about the current location of McCann’s handgun, he admitted to throwing it off a bridge into the Bogue Chitto River.

Several family members of the victim were present in the courtroom for McCann’s guilty plea and supported the sentence he received. Two of them gave victim impact statements prior to Judge Keller sentencing McCann. McCann had no prior arrest history.
